This Privacy Policy does not apply to any information collected by any third party.  Users are responsible for any third-party data they provide or share through the Service and confirm that they have the third-party’s consent to provide such data to us.  Users should review any third party’s privacy policy before using any of their services.

• TDW may request that you voluntarily submit your resume or CV, cover letter, work experience, recommendation, education, transcripts, licenses, information obtained in an interview, details regarding a job position, details regarding desired or potential salary or location of a job or contract, or any other information provided by, relevant to, or in support of the application or recruiting process, or a job or contract; 

• Your information that we may deem relevant related to a potential job or contract;

• Information relating to business entities, including affiliation, and details regarding certain job postings or contract opportunities that you provide, and any other details regarding certain employment opportunities that we deem relevant; and

• Other information that is not specifically listed here, which we will use in accordance with this Privacy Policy.  

We may collect and/or combine, aggregate, or otherwise compile the information collected from you when you use the Service, as further explained in Section B of this Privacy Policy.   You acknowledge that your access and use of certain portions of the Service is conditioned on your provision of such Personal Information. You may decline or revoke your prior authorization to share certain Personal Information with us, in which case we may not be able to provide to you some or all of the features and functionality of the Service.

When you access and use the Service, including browsing the Site without actively and voluntarily providing us information in response to direct and explicit prompts for the same, we may use technology to collect information that is sent to us automatically regarding your computer or mobile device and internet connection, including but not limited to the device’s unique device identifier, IP address, operating system, browser type, network information and the device’s telephone number, and other information regarding your visit, including but not limited to the date and time you accessed the Service, the Site pages you visit, and, if you linked to the Site from a third-party website, the internet address of such third-party website.

• Provide your information regarding possible applicants or personnel for certain jobs;

• Provide your business information and job or contract details to certain prospective drivers;

• Recruiting and matchmaking between carriers, brokers and other transportation providers, and drivers;

• Provide you with information and otherwise communicate with you regarding your use of the Service;

• Respond to your electronic inquiries;

• Enforce the Terms and Conditions, located at [insert hyperlink];

• Facilitate, improve, expand, and troubleshoot the Service;

• Notify you when Service updates are available, and of changes to any products or services we offer or provide though the Service;

• Provide customized content and information;

• Make the Site more useful to visitors and learn about the number of visitors to the different sections of the Site, what information is of most and least interest, and technical information that will enhance ease of use, such as the types of technology our visitors use and system performance or problem areas;

1. Third Party Service Providers

We may share data with service providers, vendors, third parties, contractors, or agents who complete transactions or perform services on our behalf, such as those that assist us with our business and internal operations like shipping and delivery, payment processing, fraud prevention, customer service,  experiences, personalization, marketing, and advertising.  

Such service providers may include Tenstreet, LLC (“Tenstreet”).  Tenstreet hosts a platform that connects carriers and drivers.  This Privacy Policy and the Terms and Conditions do not apply to any information or data that is hosted by or otherwise subject to the control of Tenstreet, and is accordingly subject to Tenstreet’s privacy policy and/or terms and conditions.  By using this Site or Service, you expressly consent to the sharing of your data with Tenstreet where applicable to your use of the Site or Service, or otherwise voluntarily agreed.      

2. Advertising and Analytics

We use advertising and analytics technologies to better understand your online activity on our Service to provide personalized advertisements, products and services that may interest you.  We may use your Personal Information to provide personalized advertisements to you including, but not limited to, certain job opportunities or certain qualified job candidates.  

We may allow third-party companies, including ad networks, to serve advertisements, provide other advertising services and/or collect certain information when you visit our website. 

Third-party companies may use pseudonymized personal data (e.g., click stream information, browser type, time and date, subject of advertisements clicked or scrolled over) during your visit to this website in order to provide advertisements about goods and services likely to be of interest to you, on this website and others.  

If you do not wish to receive personalized ads, please visit their opt-out pages to learn about how you may opt out of receiving personalized ads from member companies.  If you do not want to receive any advertisements from us, please contact us pursuant to our contact information in Section L of this Privacy Policy.  

3. Other Users of the Service

We may share data to other users of the Service as necessary to facilitate the Service.  For example, information regarding a driver may be shared with a carrier regarding a carrier’s job posting or work available (and vice versa) as necessary to facilitate a connection and hiring, or potential hiring, between that carrier and driver.  By using the Service, you explicitly consent to such sharing of data, including Personal Information.  

4. Businesses with Potential Job Opportunities

We may share job applicant data and information to businesses or other entities who may have a job related to your work experience, whether or not that business is a user of the Service.

5. Individuals or Drivers

We may share information relating to your job posting or work need with an individual and/or driver, whether or not that individual or driver is a user of the Service.

6. Other

We may share data in connection with a corporate business transaction, such as a merger or acquisition of all or a portion of our business to another company, joint venture, corporate reorganization, insolvency or bankruptcy, financing or sale of company assets.

We may share data to enforce our rights arising from any contracts entered into between you and us, including the Terms and Conditions, and for billing and collection. 

We may share data to our subsidiaries and affiliates, for the purpose of providing the Service. 

We may share data to facilitate legal process from lawful requests by public authorities, including to meet national security or law enforcement demands as permitted by law.

We may share any data, including your Personal Information, with third parties, including Tenstreet, when we have your consent. 

We may share any data, including your Personal Information, to fulfill the purpose for which you provide it.  

We may share any data, including your Personal Information, if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of TDW, our customers or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction. 

4. How We Collect Your Information

We collect information from and about you directly from you when you provide it to us and automatically when you use the Service.  We may use session and persistent “cookies,” session logs, web beacons, GIF/pixel tags, banner ads, third-party click tracking analytics tools (such as Google Analytics), third party retargeting networks that may display our advertisements to you on other sites that you visit to remind you about us, and third party networks that serve user-requested emails (e.g., for a refer-a-friend email) to collect non-personally identifiable or other aggregated information about site visitors.

The Service may provide you with the opportunity to elect to receive future communications about our products and services. If you authorize these communications, we may contact you periodically with such information. However, if you later change your mind and would no longer like to continue receiving such communications, please contact us (our contact information in Section L of this Privacy Policy) and let us know that you would like to be removed from all further communications (or, if available, click the link at the bottom of any email you receive from us and follow the instructions). Please allow us a reasonable period of time to complete your request.  

6. Data Security

We have implemented commercially reasonable measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration and disclosure.  However, no amount of security measures can guarantee with 100% certainty complete security. 

The safety and security of your Personal Information also depends on you. You are responsible for maintaining the confidentiality of the login credentials (including your account login username and password) that we have given to you or which you have chosen to access to certain parts of the Service. Do not share your password with anyone, and users should exercise caution in providing information in any public areas of the Service. Any information you include in a publicly accessible area of the Service will be available to anyone who has access to that content, including other users of the Service. If you delete your content from the Service, copies of such content may remain viewable in cached and archived pages or might have been copied or stored by other users of the Service.

You also agree and are obligated to maintain the confidentiality of any Personal Information of any other user of the Service that you receive from us (or otherwise obtain) for purposes of facilitating the services you provide or receive using the Service.

As stated, complete security of the transmission of information via the internet and mobile platforms cannot be guaranteed. Although we have implemented commercially reasonable measures designed to secure your Personal Information, we cannot guarantee the security of your Personal Information transmitted through our Service. Any transmission of Personal Information is at your own risk. If your communication is very sensitive, or includes information such as your bank account, charge card, or social security number, you should send it by mail unless our Service indicates the particular transmission is secured. We are not responsible for the circumvention of any privacy settings or security measures we provide.

For Site security purposes and to ensure that the Site and related products and services remains available to all users, TDW employs software programs to monitor network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage.

7. Data Retention

We store the information we collect about you for as long as reasonably necessary for the purpose(s) for which we collected it or for other legitimate business purposes, including to meet our legal, regulatory, or other compliance obligations.   We will not retain information collected for longer than reasonably necessary to accomplish the legitimate business purpose for which it was collected.  This data retention policy does not apply to information or data once it is sent to third party providers such as Tenstreet, and any such information will be subject to their privacy policies, including their retention policies.     

8. State Law Privacy Rights

Except as otherwise provided, this section solely applies to residents of California, as well as other states (including Connecticut, Virginia and Nevada) whose privacy laws grant their residents certain rights herein, and only to the extent that the law requires.  If you are not a resident of a state where privacy laws exist that grant you certain rights greater than those enumerated elsewhere in this Privacy Policy, you do not qualify and are not able to exercise the rights enumerated under this Section.  This Section includes information required to be given to California residents under the California Privacy Rights Act (“CPRA”). 

 “Personal Information” has the definition given to “personal data”, “personal information” or similar terms under the applicable privacy laws of the state in which you reside. Under the CPRA, subject to certain exceptions, “personal information” is any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California resident or household.   “Sensitive Personal Information” is a type of Personal Information which requires additional security protections.  

Under the CPRA, you have the right to access the Personal Information we collect or retain about you upon request in a commonly used format.  You additionally have the right to request correction of any inaccurate Personal Information.  We will use commercially reasonable efforts to correct your Personal Information upon verification of the validity of your request within 45 days of receipt of the request.  You also have the right to request the following information about your Personal Information under the CPRA, including the Personal Information we collect, the categories of Personal Information we collect, the categories of sources from which we collect your Personal Information, the business purposes for collection or sharing of your Personal Information, the categories of Personal Information we may disclose for business purposes and the categories of third parties to whom your Personal Information is disclosed.  The Personal Information we collect and share is disclosed in this Privacy Policy.  

You also have a right to request that we delete your Personal Information under certain circumstances, subject to certain exceptions.  Upon verification of a deletion request, we will delete your Personal Information from our records, and instruct any service providers to delete your information where applicable.  

You have the right to opt-out of the sale of your Personal Information.   That said, TDW does not sell your Personal Information within the meaning of the CPRA.  

You have the right to limit the sharing of your Sensitive Personal Information.  TDW may collect financial information, including credit card information, solely for the purpose of facilitating transactions necessary for the business purposes of the Service.  TDW collects such Sensitive Personal Information with your consent and out of necessity for the completion of the Service.  TDW is not responsible for any Sensitive Personal Information collected by any third party.  

Under certain circumstances, you have the ability to opt out of tracking for targeted advertising purposes and opt out of profiling of certain consumer or individual preferences.  To opt out, contact TDW, who will use commercially reasonable efforts to opt you out of such tracking if applicable.  

You have a right not to be discriminated against for exercising rights set out in the CPRA.

Our Service is intended for adults. We do not knowingly collect personally identifiable information from children. 10. International Use

The Service is hosted in the United States. If you use the Service from a region other than the United States, you acknowledge that you are transferring your personal information from that region to the United States for storage and processing.
